Scope and contracting party

These Terms of Service govern the use of the SupportWunder service, operated by Blue Ship Media Limited, Kinyra 28, Office 303, 8011 Paphos, Cyprus ("SupportWunder", "we").

The service is intended solely for businesses, self-employed persons and other traders for commercial use (B2B); it is not directed at consumers.

By registering an account you accept these terms.

The service

SupportWunder is an AI-assisted assistant that analyses incoming support messages (email, WhatsApp, Telegram, website chat) and generates reply drafts.

By default only drafts are generated, which you review before sending. An optional automatic sending mode can be enabled by you and disabled again at any time.

We develop the service continuously and may change, add to or discontinue individual features to the extent this is reasonable for you.

Right of use

For the term of the contract we grant you a simple, non-exclusive and non-transferable right to use the service within the scope of your chosen plan and for the agreed number of users.

Sublicensing or use by third parties is not permitted without our consent.

Acceptable use

You undertake not to use the service unlawfully, not to process unlawful content, and to comply with applicable law, including data protection and competition law and the anti-spam rules of the respective messaging channels.

In particular, reverse engineering, decompiling or rebuilding the service, use for competitive purposes, and exceeding the booked number of users are prohibited.

Pricing and billing (Merchant of Record)

Use is based on the paid plan you select. The prices shown at the time of order apply, plus any statutory taxes.

Payment is processed by our payment provider Creem (Armitage Labs OÜ, Estonia) acting as Merchant of Record. Creem acts towards you as the reseller, issues the invoice and is responsible for calculating and remitting VAT. By completing payment you additionally accept Creem's buyer terms.

We remain responsible to you for providing the service itself. Chargebacks and payment disputes are to be raised with Creem in the first instance.

Term and termination

The contract runs for the selected billing period and renews for the same period unless terminated before it ends. You may terminate at any time with effect from the end of the current billing period.

The right to extraordinary termination for good cause remains unaffected.

After the contract ends, your content is deleted in accordance with our privacy policy.

Customer data and intellectual property

You remain the owner of all data and content you provide and are responsible for its lawfulness. We process it solely to provide the service and on your instructions.

All rights in the service, the underlying software and our trademarks remain with us or our licensors.

Data protection and processing on your behalf

Where we process personal data on your behalf as part of the service, we act as a processor under Art. 28 GDPR. A data processing agreement (DPA) is provided on request.

The sub-processors used and the safeguards for transfers to third countries are set out in our privacy policy.

AI-generated content notice

The reply drafts produced by the service are generated using artificial intelligence and may be inaccurate, incomplete or inappropriate. You are responsible for reviewing content before it is sent.

If you enable the optional automatic sending mode, you accept responsibility for the fact that no prior manual review takes place.

Availability and warranty

We strive for the highest possible availability of the service but do not owe any specific availability unless expressly agreed otherwise. Maintenance, third-party outages and circumstances beyond our control may limit availability.

To the extent permitted by law, the service is provided "as is".

Limitation of liability

To the extent permitted by law, our liability is limited to the amount you paid for the service in the twelve months before the event giving rise to the damage. Liability for indirect damage, consequential damage and lost profit is excluded.

Liability for intent and gross negligence, for damage arising from injury to life, body or health, and in all other cases of mandatory statutory liability remains unaffected.

Confidentiality

Each party keeps the other party's confidential information confidential and uses it only to perform the contract.

Changes to these terms

We may amend these Terms of Service with effect for the future. We will notify you of material changes in text form in good time before they take effect. If you continue to use the service after they take effect, the amended terms are deemed accepted.

Governing law and jurisdiction

The law of the Republic of Cyprus applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The courts of the Republic of Cyprus have exclusive jurisdiction over all disputes arising out of or in connection with this contract.

Final provisions

Should individual provisions of these Terms of Service be invalid, the validity of the remaining provisions remains unaffected. Together with the order and the privacy policy, these terms constitute the entire agreement between the parties.
